Terms of Service

Forthelume is a marketplace connecting independent fashion designers with buyers. Designers publish original clothing designs — including 2D listings and 3D garment models — for discovery, virtual try-on, and purchase. Garments may be produced on-demand (made after an order is placed) rather than held as pre-manufactured stock.

You must be at least 18 years old to create an account or make a purchase on Forthelume. [ADJUST: if you want to allow 13–17 year olds with parental consent, this clause needs to change and a parental-consent flow needs to exist in the product first.] By using Forthelume, you represent that you meet this requirement and that all information you provide is accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at admin@forthelume.black if you suspect unauthorized use.

If you register as a designer on Forthelume:

• Ownership. You retain full ownership of your original designs, including any 2D images and 3D garment files you upload.
• License to Forthelume. By uploading a design, you grant Forthelume a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and process your content (including generating virtual try-on renders and, where applicable, coordinating on-demand production) solely for the purpose of operating the platform.
• Your warranties. You confirm that you own or have the necessary rights to all content you upload, and that it does not infringe any third party's intellectual property, publicity, or other rights.
• Removal. We may remove any listing that violates these Terms or applicable law, with notice where reasonably possible.

Features such as comments (“Letters to the Studio”), likes (“Admirer”), saves (“Collect”), and remixes (“Remix”) allow you to interact with designs and other users. You agree not to post content that is unlawful, infringing, harassing, or fraudulent. We reserve the right to moderate, remove, or restrict content and accounts that violate this section.

Forthelume offers 2D and 3D virtual try-on, which requires you to upload a photo of yourself. By using this feature, you consent to your photo being processed — including by third-party AI service providers we work with for image generation — solely to generate your try-on render. This data is not used to build a facial recognition or biometric identification database. See our Privacy Policy for full details on how try-on photos are handled, retained, and can be deleted.

Prices are listed in Indian Rupees (INR) unless stated otherwise and are inclusive/exclusive of applicable taxes as displayed at checkout. Payments are processed through Razorpay (or another payment processor we may adopt); Forthelume does not store your full card or payment credentials. All orders are subject to acceptance and availability.

Most garments on Forthelume are made to order and are not held as pre-existing stock. Production begins after your order is confirmed. Estimated production and delivery timelines will be shown at checkout or on the product page; these are estimates, not guarantees.

Refund, cancellation, and shipping terms are set out in our Refund, Cancellation & Shipping Policy, which forms part of these Terms.

The Forthelume name, logo, platform design, and underlying software are the property of FORTHELUME PRIVATE LIMITED and may not be used without permission. Designer content remains the property of the respective designer as described in Section 4.

You agree not to: (a) upload infringing, counterfeit, or unlawful content; (b) attempt to circumvent platform security; (c) scrape, reverse-engineer, or misuse the platform; (d) use the platform for any fraudulent transaction; or (e) impersonate another person or entity.

We may suspend or terminate your account for violation of these Terms, fraudulent activity, or as required by law. You may close your account at any time by contacting us.

Forthelume is provided “as is.” To the maximum extent permitted by law, Forthelume disclaims warranties of any kind and is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Nothing in this section limits liability that cannot be excluded under applicable Indian law, including the Consumer Protection Act, 2019.

You agree to indemnify Forthelume against claims arising from your breach of these Terms, your content, or your violation of any law or third-party right.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Grievance Officer for Forthelume is:

You may reach out with complaints regarding content on the platform or violations of these Terms. We aim to acknowledge complaints within 24 hours and resolve them within the timeframe prescribed by applicable law.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana.

We may update these Terms from time to time. Material changes will be notified via the platform or email. Continued use after changes take effect constitutes acceptance.
